Un salarié qui totalise au moins 24 mois d’ancienneté au sein d’une entreprise ou d’un groupe de 300 salariés et plus peut désormais demander à son employeur d’exercer temporairement une activité professionnelle chez un autre employeur en vue, par exemple, d’acquérir de nouvelles compétences.
Par cette sorte de congé sabbatique professionnel, il garde la faculté de revenir dans son entreprise d’origine en retrouvant son emploi ou un emploi de nature similaire, assorti d’une rémunération et d’une qualification au moins équivalente.
La mise en place de cette mobilité externe « sécurisée » nécessite la conclusion d’un avenant au contrat de travail dont l’objet est de fixer les modalités de l’absence et de l’éventuel retour du salarié.
Précision : l’avenant doit ainsi mentionner le délai dans lequel le salarié informe l’employeur de son choix de ne pas réintégrer son entreprise d’origine. Si le salarié exerce cette faculté, il est alors considéré comme démissionnaire.
