Déjà amorcée en 2014, la simplification des obligations incombant aux employeurs en matière d’affichage dans le cabinet et de transmission de certains documents à l’administration a franchi une nouvelle étape.
Ainsi, l’employeur n’est plus tenu d’afficher, entre autres, le règlement intérieur, l’intitulé des conventions et accords applicables dans le cabinet, l’ordre des départs en congé et les textes de loi relatifs à l’égalité de rémunération entre les hommes et les femmes. En effet, ces informations, qui doivent toujours être portées à la connaissance des salariés, et pour certaines, aux candidats à l’embauche, peuvent à présent leur être communiquées par tout moyen.
En pratique : si ces informations peuvent encore faire l’objet d’un affichage au sein de l’établissement, elle peuvent aussi, désormais, être adressées par courriel, figurer sur le site Intranet du cabinet, etc.
Par ailleurs, la transmission systématique par l’employeur de certaines informations à l’inspection du travail disparaît. Autrement dit, l’employeur adresse ces informations à l’administration uniquement si elle lui en fait la demande. Sont concernés, par exemple, l’avis du comité d’entreprise sur la mise en place d’horaires à temps partiel ou le récépissé de la déclaration préalable effectuée auprès de la Cnil pour la mise en œuvre d’un traitement automatisé de données à caractère personnel concernant le contrôle de la durée du travail. L’obligation de transmettre à l’inspection du travail un duplicata de l’affiche relative à l’horaire collectif de travail est également supprimée.
Précision : ces nouvelles règles sont applicables depuis le 23 octobre 2016.
