Démarcher des particuliers par téléphone à des fins commerciales est de plus en plus encadré. Dernière mesure en date, un décret vient de fixer les jours et les heures pendant lesquels le démarchage téléphonique est autorisé ainsi qu’une limite à la fréquence des appels.
Précision : ces nouvelles obligations entreront en vigueur à compter du 1er mars 2023.
Pas le week-end ni les jours fériés
Ainsi, à compter du 1er mars 2023, les professionnels ne pourront téléphoner à des particuliers à des fins de prospection commerciale que du lundi au vendredi, sauf les jours fériés, et de 10 heures à 13 heures et de 14 heures à 20 heures seulement.
Cet encadrement s’applique aussi bien aux personnes non inscrites sur la liste d’opposition au démarchage téléphonique, dite « Bloctel », qu’à celles qui y sont inscrites mais qui sont sollicitées dans le cadre d’un contrat en cours.
Exception : appeler un particulier en dehors de ces jours et de ces plages horaires sera toutefois possible lorsque ce dernier y aura consenti expressément et au préalable. Le professionnel devra pouvoir justifier ce consentement.
Pas plus de 4 fois par mois
La fréquence des appels sera également limitée à compter du 1er mars 2023. Ainsi, à partir de cette date, il sera interdit à un professionnel d’appeler un même particulier plus de 4 fois sur une période de 30 jours.
Et si le particulier refuse ce démarchage lors de l’appel, le professionnel ne pourra plus le contacter avant l’expiration d’une période de 60 jours à compter de ce refus.
Attention : le professionnel qui ne respectera pas ces règles encourra une amende administrative pouvant aller jusqu’à 75 000 € s’il s’agit d’une personne physique et jusqu’à 375 000 € s’il s’agit d’une société.
