Car lorsqu’il se trouve à moins de cinq ans de l’âge légal lui permettant de partir à la retraite ou de l’âge lui permettant de bénéficier d’une retraite à taux plein, l’exploitant locataire peut s’opposer à la reprise des terres louées par son bailleur et bénéficier de plein droit d’une prorogation de son bail pour une durée lui permettant d’atteindre cet âge. Avec le relèvement progressif de l’âge légal de départ à la retraite de 62 à 64 ans, cette prorogation peut donc, selon les cas, s’allonger.
