Depuis l’an dernier, les notaires et les avocats ont à leur disposition un outil sécurisé de signature électronique pour les conventions de divorce par consentement mutuel, baptisé « e-DCM ». Ce module permet de réaliser des actes d’avocat natifs électroniques, puis de transmettre une e-convention de divorce au notaire, par voie électronique, depuis la plate-forme e-Actes d’avocat.
Pour rappel, l’outil e-DCM a été développé par le Conseil national des barreaux (CNB) en lien avec le Conseil supérieur du notariat (CSN). La mise en œuvre du e-divorce par consentement mutuel étant encadrée par un avenant à une charte commune signée entre le CSN et le CNB.
Le 25 juillet 2023, le CNB et le CSN ont modifié cet avenant afin d’imposer l’usage de l’outil e-DCM pour l’établissement des conventions de divorce signées et déposées électroniquement. En effet, ils soulignent que cet outil est le seul à même de garantir le respect des exigences légales et déontologiques. De plus, il respecte les contraintes techniques permettant l’intégration de la convention de divorce électronique dans un acte authentique électronique.
Les avocats ont donc désormais l’obligation de recourir à l’outil e-DCM pour réaliser tout acte contenant une convention de divorce électronique, sous peine de se voir opposer un refus du notaire de procéder au dépôt de la convention.
